Overview
This HIPAA Notice of Privacy Practices (“Notice”) describes how Pathway To Mental Wellness and its licensed health care professionals (“we,” “us,” or “our”) may use and disclose your health information and explains your rights regarding your health information under the Health Insurance Portability and Accountability Act (“HIPAA”).
We are required by law to:
• Make sure health information that identifies you is kept private.
• Provide you with this Notice of our legal duties and privacy practices.
• Notify you following a breach of your unsecured protected health information.
• Follow the terms of the Notice currently in effect.
We reserve the right to change our privacy practices and the terms of this Notice. Updates will apply to all health information we maintain, including information collected prior to the update. A current copy of this Notice will always be available upon request.
How Your Information is Used
We may use and disclose your health information for treatment, payment, and health care operations.
Examples include:
• Treatment: Sharing information with another provider involved in your care (e.g., referral to a prescriber).
• Payment: Using health information to verify insurance, submit claims, and obtain payment.
• Health Care Operations: Reviewing treatment records for quality assurance, compliance, or training purposes.
We may also participate in health information exchanges (HIEs), allowing your health information to be shared securely with other providers for treatment, payment, or health care operations, unless you opt out as permitted by your state law.
Disclosures That Do Not Require Authorization
We may disclose your health information without your written authorization in the following circumstances:
• Emergencies to ensure you receive needed care.
• Judicial or Administrative Proceedings when required by court order or law.
• Public Health Activities such as reporting risks to yourself or others.
• Child or Elder Abuse/Neglect when required by law.
• Criminal Activity or Danger to Others when necessary for safety.
• Health Oversight Activities such as audits or inspections.
• Business Associates who perform services on our behalf under strict confidentiality agreements.
• Research under specific safeguards permitted by law.
• Appointment Scheduling/Reminders via phone, text, or email.
Your Individual RightsYou have the right to:
• Inspect and copy your medical records (reasonable fees may apply).
• Request amendments if you believe information is inaccurate.
• Request an accounting of disclosures made for purposes other than treatment, payment, or operations.
• Request restrictions on certain uses/disclosures (we may not always be able to agree).
• Request confidential communications (e.g., contact only at work or by mail).
• File a complaint if you believe your rights have been violated. You may file with us or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.

Email and Text Communications
If you choose to communicate with us via email or text message, please be aware that these methods have inherent privacy risks. Although Pathway To Mental Wellness utilizes secure communication platforms such as Spruce, electronic communications including email and text messaging may still carry privacy and security risks. At your provider’s discretion, these communications may become part of your medical record. Do not use email or text messaging for emergencies. Please call 911 or go to the nearest emergency room.
